Buyer Terms

Version active 1.2

août 29, 2026 efficace · EN

These Buyer Terms (“Buyer Terms”) govern the purchase, download, installation, access, and use of software, source code, SaaS products, mobile applications, themes, plugins, templates, components, documentation, and other digital products (“Products”) offered through KODEMARKET at https://kodemarket.co/public/ (“Platform”).

By creating an account, placing an order, downloading a Product, or otherwise using the Platform as a buyer, you agree to these Buyer Terms, the Privacy Policy, the applicable Product license, and any additional terms displayed on the Product page or during checkout.

If you do not agree to these terms, you must not purchase or use Products through the Platform.

1. About KODEMARKET

KODEMARKET operates an online marketplace that enables independent creators, developers, and sellers (“Sellers”) to list and sell digital Products to buyers.

Unless a Product is expressly identified as being sold directly by KODEMARKET:

  • the Seller is responsible for the Product, its description, functionality, documentation, compatibility, updates, and support;

  • KODEMARKET acts as the marketplace operator and transaction facilitator; and

  • purchasing a Product does not create an employment, partnership, agency, or joint-venture relationship between the buyer, Seller, and KODEMARKET.

KODEMARKET may review, approve, reject, suspend, or remove listings, but such actions do not constitute a guarantee or endorsement of any Product.

2. Buyer eligibility and account

To make a purchase, you must:

  • be at least 18 years old or have the legal capacity and authorization necessary to enter into a binding agreement;

  • provide accurate, complete, and current information;

  • use a valid payment method that you are authorized to use; and

  • comply with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activities performed through your account.

You must promptly notify KODEMARKET if you believe that your account or purchased files have been accessed without authorization.

KODEMARKET may request identity, payment, or transaction verification where reasonably necessary to prevent fraud, unauthorized transactions, sanctions violations, or misuse of the Platform.

3. Product information and buyer responsibility

Before purchasing a Product, you must review the Product page carefully, including:

  • Product description and included features;

  • technical requirements and dependencies;

  • supported operating systems, frameworks, programming languages, and versions;

  • installation instructions and documentation;

  • license type and permitted usage;

  • support period and scope;

  • update policy;

  • demo, screenshots, and limitations; and

  • any third-party services, APIs, hosting, subscriptions, licenses, or fees required to operate the Product.

You are responsible for determining whether a Product is appropriate and compatible with your intended use, technical environment, infrastructure, skills, and applicable legal requirements.

Demonstrations, screenshots, and previews are illustrative. Minor visual or operational differences may occur depending on configuration, hosting environment, third-party services, software versions, or buyer modifications.

4. Orders and payments

Prices are displayed in the currency shown at checkout. Applicable taxes, payment-processing charges, currency-conversion fees, or other charges may be added where required.

By submitting an order, you authorize KODEMARKET and its payment service providers to charge the total amount displayed at checkout.

An order is completed only after payment has been successfully authorized and confirmed. KODEMARKET may decline, cancel, or hold an order for verification where fraud, payment error, pricing error, legal restriction, or unauthorized activity is suspected.

The buyer is responsible for any taxes, duties, bank charges, or currency-conversion fees not collected by the Platform.

Promotional prices, discount codes, and special offers may be subject to separate conditions and may be changed or withdrawn at any time before an order is completed.

5. Digital delivery

Products are normally delivered electronically through the buyer’s account, a secure download link, license credentials, repository access, or another method described on the Product page.

You must download and securely store purchased files within any stated availability period. KODEMARKET does not guarantee that a Product will remain available for unlimited re-download.

You must not share download links, account credentials, license keys, repositories, or Product files with unauthorized persons.

If you cannot access a purchased Product, you should contact support promptly and provide the relevant order information.

6. Product license

A purchase gives you a limited license to use the Product. It does not transfer ownership of the Product, source code, trademarks, documentation, or other intellectual property unless expressly stated in writing.

The license displayed on the Product page or supplied with the Product governs your use of that Product. If there is a conflict between these Buyer Terms and a Product-specific license, the Product-specific license will control solely regarding the scope of permitted Product usage.

Unless expressly permitted by the applicable license, you must not:

  • resell, redistribute, sublicense, share, lease, or make the Product available as a standalone product;

  • publish the Product or its source code in a public repository;

  • remove or alter copyright, trademark, attribution, or license notices;

  • use one license for more users, installations, domains, applications, or end products than permitted;

  • provide the Product through a download, asset library, template service, or competing marketplace;

  • use the Product to infringe intellectual property, privacy, publicity, or other legal rights;

  • circumvent license verification, access controls, download restrictions, or security measures; or

  • use the Product for malware, phishing, fraud, unauthorized surveillance, illegal content, or any unlawful activity.

You may modify a Product only to the extent allowed by its license. Modifying a Product may affect your eligibility for support, updates, or refunds.

7. Third-party components and services

A Product may contain or depend on open-source software, third-party libraries, APIs, cloud services, payment gateways, fonts, media, data, or other external components.

Those components may be governed by separate licenses, terms, pricing, usage limits, and privacy policies. You are responsible for reviewing and complying with them.

Unless expressly stated otherwise, the purchase price does not include third-party subscriptions, hosting, domains, API usage, app-store fees, payment-processing fees, premium extensions, or other external costs.

KODEMARKET and the Seller are not responsible for changes, interruptions, discontinuation, or pricing changes made by third-party providers.

8. Installation, customization, and deployment

Unless expressly included on the Product page, the purchase price does not include:

  • installation or deployment;

  • hosting or server configuration;

  • customization or feature development;

  • data migration;

  • branding or content preparation;

  • third-party integration;

  • app-store submission or approval;

  • legal or regulatory compliance review; or

  • ongoing maintenance.

You are responsible for creating backups and testing the Product in a safe development or staging environment before production deployment.

You must not install or execute unverified files in a production environment containing sensitive or irreplaceable data.

9. Support and updates

The available support period, response channel, support scope, and update entitlement are stated on the Product page or in the applicable license.

Unless expressly included, support does not cover:

  • general programming or business consulting;

  • installation or configuration outside the documented requirements;

  • custom features or design changes;

  • problems caused by buyer modifications;

  • unsupported software versions or environments;

  • third-party products or services;

  • server, hosting, network, or security issues outside the Product; or

  • recovery from misuse, unauthorized access, or failure to maintain backups.

Response and resolution times are estimates unless a separate service-level agreement has been provided.

Updates may change, remove, or replace features where reasonably necessary for security, compatibility, maintenance, or legal compliance. Lifetime updates or lifetime support apply only when expressly stated and are subject to the continued availability of the Product and Seller.

10. Refunds

Digital Products are generally delivered immediately and cannot be physically returned. A change of mind, lack of technical knowledge, failure to review the Product requirements, or incompatibility that was clearly disclosed before purchase will not normally qualify for a refund.

A refund may be considered where:

  • the buyer did not receive access to the Product after payment;

  • the downloaded file is materially corrupted and no working replacement is provided;

  • the Product is materially different from its description;

  • a reproducible material defect prevents the Product’s primary advertised function and is not corrected within a reasonable time;

  • the same order was charged more than once; or

  • a refund is required by applicable consumer law.

A refund will generally not be provided where:

  • the buyer changes their mind;

  • the buyer lacks the required skills, software, hosting, infrastructure, or third-party services;

  • the Product is incompatible with an environment not listed as supported;

  • the issue results from buyer modifications or misuse;

  • a third-party component or service changes or becomes unavailable;

  • the buyer refuses to provide reasonable information needed to investigate the issue;

  • the buyer has violated the applicable license or these Buyer Terms; or

  • the request concerns a feature that was not advertised as included.

Refund requests must be submitted through the Platform or to [email protected] within 30 days after purchase and must include the order number, description of the issue, relevant screenshots or logs, and reasonable steps taken to resolve it.

Nothing in this section limits any non-excludable consumer rights under applicable law.

11. Payment disputes and chargebacks

Before initiating a payment dispute or chargeback, you should contact KODEMARKET and allow a reasonable opportunity to investigate and resolve the issue.

Submitting a fraudulent, misleading, or abusive chargeback may result in suspension of your account, revocation of Product licenses and downloads, recovery of associated costs, and other action permitted by law.

KODEMARKET may provide transaction records, access logs, download records, communications, and acceptance of these Buyer Terms to the relevant payment provider when responding to a dispute.

12. Reviews and communications

Only buyers with genuine experience of a Product may submit reviews. Reviews must be honest, relevant, and must not contain unlawful, abusive, defamatory, deceptive, confidential, or personally identifying content.

KODEMARKET may moderate or remove reviews that violate Platform rules, but will not remove a review solely because it is negative.

Communications with Sellers and support personnel must remain professional. Harassment, threats, spam, attempts to bypass Platform protections, or requests for unlawful assistance are prohibited.

13. Security and responsible use

Software inherently carries technical and security risks. You are responsible for:

  • reviewing and testing Products before production use;

  • applying appropriate access controls and security configurations;

  • protecting license keys and credentials;

  • maintaining backups and recovery procedures;

  • installing security updates;

  • conducting appropriate security review where sensitive data or critical systems are involved; and

  • ensuring that your use complies with privacy, cybersecurity, consumer-protection, export-control, sanctions, and industry-specific requirements.

You must notify KODEMARKET privately and promptly if you discover a suspected vulnerability affecting a Product or the Platform. You must not exploit, publicly disclose, or use a vulnerability to access data or systems without authorization.

14. Intellectual-property complaints

If you believe that a Product infringes your intellectual-property rights, please contact [email protected] with sufficient information to identify the work, the allegedly infringing Product, your authority to submit the complaint, and your contact details.

KODEMARKET may suspend access to disputed material while investigating a complaint.

15. Suspension and termination

KODEMARKET may restrict, suspend, or terminate your account or access where reasonably necessary because of:

  • violation of these Buyer Terms or a Product license;

  • fraud, unauthorized payments, or abusive chargebacks;

  • sharing, redistribution, or resale of Products without permission;

  • unlawful, harmful, or abusive conduct;

  • security risks; or

  • a legal, regulatory, court, or payment-provider requirement.

Termination does not grant permission to continue using a Product after its license has been revoked. Provisions concerning payment obligations, intellectual property, limitations of liability, indemnification, and dispute resolution survive termination where applicable.

16. Disclaimer

To the maximum extent permitted by law, Products and the Platform are provided “as is” and “as available.”

KODEMARKET does not guarantee that every Product will be error-free, continuously available, suitable for every purpose, compatible with every environment, secure against every threat, or accepted by any app store, regulator, payment provider, or third-party service.

Descriptions and support commitments supplied by independent Sellers remain the responsibility of those Sellers.

Nothing in these Buyer Terms excludes warranties or rights that cannot legally be excluded.

17. Limitation of liability

To the maximum extent permitted by applicable law, KODEMARKET will not be liable for indirect, incidental, special, punitive, or consequential losses, including loss of profits, revenue, data, business opportunity, goodwill, or anticipated savings arising from the purchase or use of a Product.

To the extent liability cannot be excluded, KODEMARKET’s aggregate liability relating to a particular order will not exceed the amount paid through the Platform for that order during the twelve months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

18. Buyer indemnification

To the extent permitted by law, you agree to indemnify and hold harmless KODEMARKET, its affiliates, officers, employees, and service providers from claims, losses, liabilities, and reasonable costs arising from:

  • your unlawful use or distribution of a Product;

  • your breach of these Buyer Terms or a Product license;

  • your modifications, deployment, operation, or combination of a Product with other systems; or

  • your infringement of another person’s rights.

19. Changes to these Buyer Terms

KODEMARKET may update these Buyer Terms to reflect changes to the Platform, business practices, legal requirements, or security standards.

The revised terms will be published with a new effective date. Where required, KODEMARKET will provide additional notice.

Changes will not retroactively alter the license or material rights attached to a completed purchase unless required by law or agreed by the buyer.

20. Governing law and disputes

These Buyer Terms are governed by the laws of Thailand, without regard to conflict-of-law principles.

Before commencing formal proceedings, you and KODEMARKET agree to attempt in good faith to resolve the dispute by contacting support and allowing at least 30 days for resolution.

Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Thailand, except where applicable consumer law gives you the right to bring a claim in another jurisdiction.

21. General provisions

If any provision of these Buyer Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

A failure to enforce any provision is not a waiver of that provision.

You may not transfer your account, order, or license except as expressly allowed by the applicable license. KODEMARKET may assign its rights and obligations in connection with a merger, acquisition, restructuring, or transfer of the Platform.

These Buyer Terms, the applicable Product license, the Product page, the Privacy Policy, and any terms displayed during checkout constitute the agreement governing your purchase.
